Important: By downloading, installing, or using any application published by Musica Medica (including Musica Medica and AnyMusic), you confirm that you have read, understood, and agree to be bound by these Terms of Service and End User License Agreement. If you do not agree, do not use our apps.

1. About These Terms

These Terms of Service and End User License Agreement ("Terms") constitute a legally binding agreement between you ("User", "you") and Musica Medica, operated by Prof. Dr. Y. Schiftan, c/o F2BII E-Commerce, Hintergoldingerstrasse 30, 8638 Goldingen, Switzerland ("we", "us", "our", "Licensor").

These Terms apply to all software applications, mobile apps, and related services published under the Musica Medica brand, including but not limited to:

  • Musica Medica – a vibroacoustic therapy and wellness app.
  • AnyMusic – a music and sound experience app.

Collectively, these are referred to as the "App(s)" or "Service(s)" throughout these Terms.

2. Description of Our Apps

2.1 Musica Medica

Musica Medica is a wellness application delivering vibroacoustic therapy experiences designed to support relaxation, focus, and general well-being. The app provides curated sound and vibration programmes intended for personal, non-clinical use.

2.2 AnyMusic

AnyMusic is a music and sound experience application offering audio content and interactive features to support listening enjoyment and well-being. Features may include curated playlists, audio streams, and personalisation tools.

2.3 Eligibility

You must be at least 16 years of age to use our Apps. If you are between 16 and 18, you confirm that you have obtained parental or guardian consent. We do not knowingly permit use by children under 16.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

  • Download and install the App on a personal device that you own or control.
  • Access and use the App solely for your own personal, non-commercial purposes.

This licence does not grant you any rights to the underlying software, source code, or intellectual property beyond what is expressly stated in these Terms. All rights not expressly granted are reserved by Musica Medica.

4. Restrictions on Use

You agree that you will not, and will not permit others to:

  • Copy, modify, adapt, translate, or create derivative works of the App or any content within it.
  • Reverse-engineer, disassemble, decompile, or attempt to extract the source code of the App.
  • Sell, sublicence, rent, lease, lend, or otherwise distribute the App or any rights therein to third parties.
  • Remove, obscure, or alter any proprietary notices, labels, or branding in the App.
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Use the App to upload, transmit, or distribute harmful, offensive, or infringing content.
  • Use automated tools (bots, scrapers, crawlers) to access or interact with the App.
  • Attempt to gain unauthorised access to any part of the App, servers, or networks connected to the App.
  • Use the App in any manner that could damage, disable, overburden, or impair our servers or services.
  • Use the App for commercial purposes without our prior written consent.

5. User Accounts

5.1 Account Registration

Some features of our Apps may require you to create an account. When registering, you agree to provide accurate, current, and complete information and to keep your account details up to date.

5.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at info@musicamedica.ch if you suspect any unauthorised use of your account.

5.3 Account Termination

You may delete your account at any time via the App's settings or by visiting our Account Deletion page. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions & In-App Purchases

6.1 Paid Features

Certain features of our Apps may require payment, including subscriptions or one-time in-app purchases. All prices are displayed clearly before purchase and may be subject to applicable taxes.

6.2 Subscription Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Renewal charges will be applied to your payment method on file through the applicable app store (Apple App Store or Google Play).

6.3 Cancellations & Refunds

To cancel a subscription, you must do so through the app store through which you originally subscribed (Apple App Store or Google Play). Refund requests are subject to the refund policy of the applicable app store. We do not process refunds directly. Unused portions of subscription periods are generally non-refundable, except where required by applicable law.

6.4 Free Trials

Where a free trial is offered, you will not be charged during the trial period. After the trial ends, your subscription will automatically begin unless you cancel before the trial period expires.

6.5 Price Changes

We reserve the right to change subscription prices at any time. We will provide reasonable notice of any price changes. Your continued use of a subscription after a price change constitutes acceptance of the new price.

7. Intellectual Property

7.1 Ownership

The Apps and all content within them — including but not limited to software, audio content, graphics, logos, text, and user interface design — are the exclusive property of Musica Medica or its licensors and are protected by Swiss, EU, and international copyright, trademark, and intellectual property laws.

7.2 Audio Content

All audio content, soundscapes, and music tracks available within our Apps are either owned by Musica Medica or used under licence from rights holders. You may not record, reproduce, distribute, or publicly perform any audio content from our Apps without prior written authorisation.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas about our Apps, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without compensation to you.

8. Medical & Wellness Disclaimer

Our Apps are wellness tools, not medical devices or medical treatments.

  • The content and functionality of Musica Medica and AnyMusic are provided for general well-being and informational purposes only.
  • Nothing in our Apps constitutes medical advice, diagnosis, or treatment.
  • Our Apps are not intended to replace consultation with a qualified healthcare professional.
  • If you have a medical condition, are pregnant, have implanted medical devices (such as pacemakers), or have any health concerns, consult your doctor before using our Apps.
  • You use our Apps at your own risk. We make no representation that the App is appropriate for, or will produce specific health outcomes for, any individual user.

9. Privacy & Data

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Apps, you consent to the practices described in the Privacy Policy.

We comply with the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (nFADP).

10. Third-Party Services

Our Apps may integrate with or link to third-party services, platforms, or content (such as the Apple App Store, Google Play, or analytics providers). These third-party services are governed by their own terms and privacy policies, and we are not responsible for their practices or content.

The availability of third-party integrations may change and is not guaranteed. We are not liable for any harm resulting from your use of or reliance on third-party services.

11. App Updates & Availability

We may release updates, patches, or new versions of our Apps from time to time. Updates may be required for continued use of certain features. We reserve the right to modify, suspend, or discontinue any feature or the App in its entirety, with or without notice, at any time.

We do not guarantee that the Apps will be available continuously, error-free, or uninterrupted. Temporary downtime for maintenance or technical issues does not constitute a breach of these Terms.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our Apps and all content within them are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the App will meet your requirements or produce specific results.
  • Warranties that the App will be error-free, secure, or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of implied warranties; in such cases, the above exclusions apply to the fullest extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Musica Medica, its officers, employees, affiliates, and licensors shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Damages arising from your use of, or inability to use, our Apps.
  • Damages resulting from errors, omissions, or inaccuracies in content.
  • Health-related outcomes or adverse effects arising from use of the Apps.

In any case, our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid (if any) for the App or subscription in the twelve (12) months preceding the event giving rise to the claim, or CHF 50, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Swiss law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Musica Medica and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your use of or access to the Apps.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of any third party.

15. Termination

These Terms remain in effect until terminated by you or by us.

We may terminate or suspend your access to our Apps immediately, without prior notice, if you breach any provision of these Terms or if we decide to discontinue the App or any part of it.

Upon termination, your licence to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and governing law — shall survive.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict-of-law principles.

Any disputes arising out of or in connection with these Terms or the use of our Apps shall first be attempted to be resolved through good-faith negotiation. If no resolution is reached within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts of St. Gallen, Switzerland.

If you are a consumer located in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App or via email.

Your continued use of our Apps after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our Apps.
